1. Acceptance
By accessing or using CaptureVantage ("the Service"), you agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. The Service
CaptureVantage provides federal contracting intelligence software, including opportunity matching, eligibility analysis, fit scoring, incumbent intelligence, and proposal support tools. We may update, modify, or discontinue features with reasonable notice to subscribers.
3. Accounts and access
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@capturevantage.com if you suspect unauthorized access.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access another organization's workspace or data
- Reverse engineer, scrape, or systematically extract data from the platform
- Resell or redistribute Service outputs without written permission
- Upload malicious code or interfere with Service operation
5. Subscription and billing
Paid plans are billed monthly or annually in advance. Fees are non-refundable except as required by law. We may change pricing with 30 days' notice to existing subscribers. Failure to pay may result in suspension of access after a 7-day grace period.
6. Data ownership
You own your data. CaptureVantage does not claim ownership of your company profile, pursuit records, compliance matrices, or any content you create in the platform. We receive a limited license to process your data solely to provide the Service. Upon account termination, you may export your data; we will delete it within 90 days unless retention is required by law.
7. Disclaimers
CaptureVantage provides intelligence tools to support bid/no-bid decisions. We do not guarantee contract awards, scoring accuracy for every opportunity, or completeness of third-party data sources (SAM.gov, USAspending.gov, etc.). Eligibility determinations are based on information you provide and public data — final compliance responsibility rests with your organization.
8. Limitation of liability
To the maximum extent permitted by law, CaptureVantage's total liability for any claim arising from your use of the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or proposal costs.
9. Termination
Either party may terminate at any time. You may cancel your subscription in account settings. We may suspend or terminate accounts that violate these terms. Sections on data ownership, disclaimers, and limitation of liability survive termination.
10. Governing law
These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Fairfax County, Virginia.
